Summons issued on President Gotabaya by Jaffna MC quashed

Jaffna Magistrates Court

The summons issued on President Gotabaya Rajapakse by the Jaffna Magistrates’ Court was quashed by the Court of Appeal on Tuesday, 24 th November. The Jaffna Magistrate’s Court had issued summons on President Gotabaya as former Secretary of Defence to provide evidence for Habeas Corpus inquiry into the 2011 disappearance of two activists.

The Bench comprised of President of the Court of Appeal A. H. M. B. Nawaz and Justice Sobitha Rajakaruna.

Court made the order delivering the verdict on the petition filed by Gotabaya Rajapaksa against the summons. The Judgement stated that while a Magistrate had the legal right to summon witnesses for a case or an inquiry, the witness must be informed clearly as to why he/she is being summoned.
