The hearing of petitions challenging 20A to commence before the Supreme Court today

A number of petitions filed by political parties, civil rights group, professionals etc challenging the 20th Amendmment are to be heard before a Five Judge Bench of the Supreme chaired by Chief Justice Jayantha Jayasuriya today, Tuesday, September 29.

The Bench comprises Chief Justice Jayantha Jayasuriya, Justices Buwaneka Aluwihare, Justice Sisira de Abrew, Justice Priyantha Jayawardena and Justice Vijith Malalgoda.

Thirty nine Special Determination petitions have been filed so far against the twentieth amendment to the Constitution. The petitioners seeking a declaration that the bill in whole or in part thereby requires the approval by people at a referendum and requires a two-thirds majority in Parliament.

Accordingly, these petitions will be heard before a five-judge-Bench comprising Chief Justice Jayantha Jayasuriya, Justices Buwaneka Aluwihare, Justice Sisira de Abrew, Justice Priyantha Jayawardena and Justice Vijith Malalgoda.

In terms of Article 121 (3) of the Constitution, the Supreme Court shall make and communicate its determination to the President and to the Speaker within three weeks of the filing of the petition.

Thirtynine parties including former Finance Minister Mangala Samaraweera, Samagi Jana Balawegaya Parliamentarian Mayantha Dissanayake National Election Commission member Prof. Ratnajeevan Hoole, UNP General Secretary Akila Viraj Kariyawasam, UNP Deputy Leader Ruwan Wijewardene filed petitions as of yesterday evening bringing total petitions to 39. Among them are; Attorney-At-Law Indika Gallage, TNA leader R. Sampanthan, Centre for Policy Alternative, SJB General Secretary Ranjith Madduma Bandara, Anil Kariyawasam, Nagananda Kodituwakku, S.S.C. Elankovan, Sithara Shreen Abdul Saroor, Transparency International, former Central Province Governor Keerthi Tennakoon, Rasika Jayakody, Lihini Fernando, Young Lawyers Association, General Secretary at Ceylon Mercantile, Industrial and General Workers Union Sylvester Jayakody, Dr. Ajantha Perera, Ceylon Teachers Union, T.D.B. Wijegunawardena and G.K.R. Perera.
