Case against ex CJ Sarath Silva; Justice Jayawardena recuses

Justice Prasanna Jayawardena, one of the judges of the Supreme Court Bench hearing the contempt of Court case against former Chief Justice Sarath N. Silva on Wednesday declined to sit on the Bench.

Justice Jayawardena stated that a matter of impropriety arises for him to hear this application since he served on the Bench that issued an Interim Order against the dissolution of the Parliament, which is a subject matter of the contempt of court action.

The Bench comprised Justice Prasanna Jayawardena, Justice Murdu Fernando and Justice E.A.G.A. Amarasekera. Court re-fixed the case for support on June 28.

Justice Jayawardena stated that it is not proper him to hear this application since he sat on the bench that issued an Interim Order against the dissolution of the Parliament, which is considered as the subject matter of this contempt of court action.
