CA issues interim order restraining PM Mahinda and cabinet from functioning

Court of Appeal on Monday issued an interim order restraining Prime Minister Mahinda Rajapaksa and his Cabinet from functioning until the conclusion of the hearing of the Writ of Quo Warranto filed against them from holding office.

The court fixed dates from December 12 to proceed with the hearing of the petition while notice was also issued on the 49-member Cabinet including Prime Minister Rajapaksa to appear before the court on that date.

The interim order was delivered by Court of Appeal Bench comprising President Justice Preethi Padman Surasena and Justice Arjuna Obeysekara.

Court also granted leave to proceed with the Quo Warranto petition and issued notice on the respondents to appear before the court and give testimonies. The interim order will be effective until the hearing of the petition concludes.

Court said: “An interim order is granted against the first respondent functioning as the prime minister...also issuing interim order against the other respondents functioning in their offices.”

Court of Appeal heard the Writ of Quo Warranto which was filed by 122 Members of Parliament including members of the UNF, TNA, JVP, SLMC and ACMC.
