Court says 'no' to plea to ban protest in Welikade


The Colombo Additional Magistrate Kanchana de Silva has refused an application by Welikada Police for a Court order to ban the Joint Opposition's protest within the Welikada police division.

Court also observed that the police have the right to take action on any incident which would disrupt the peace.

In its application Welikada Police stated that they had received intelligence reports of protest rallies which would disrupt public peace in the Welikada police division. Therefore in the interest of maintaining law and order they request the court to order a ban on such protest rallies being held within aforementioned police division.

Defense counsel submitted that the application cannot be maintained since such an application can only moved by an officer holding a rank of at least Assistant Superintendent of Police or higher.

The counsel further submitted that this protest rally would not disrupt the public peace. The freedom of speech and freedom of assembly have been guaranteed by the Constitution.

He pleaded that the Court should refuse the application made by Welikada police.
